Paterson Trio Arrested on Attempted Murder Charges for Stabbing of 15-Year-Old Teen

Passaic County Prosecutor Camelia M. Valdes and Deputy Paterson Police Chief Ibrahim Baycora announce that based upon an investigation by the Paterson Police Department, in conjunction with the Passaic County Prosecutor’s Office, officials have arrested three men in connection with a stabbing incident that took place on November 14th in the area of 40 Lewis Street Paterson.

Authorities charged Estiby R. Fernandez, 21-years-old, from Paterson with Attempted Murder, First Degree, Unlawful Possession of a Weapon, Fourth Degree; and Possession of a Weapon for an Unlawful Purpose, Third Degree.

Authorities charged Robert W. Pena-Marzan, 18-years-old from Paterson, with Attempted Murder, First Degree, Unlawful Possession of a Weapon, Fourth Degree; and Possession of a Weapon for an Unlawful Purpose, Third Degree.

Authorities charged Jimmy Polanco, 22-years-old from Paterson, with Attempted Murder, First Degree, Unlawful Possession of a Weapon, Fourth Degree; Possession of a Weapon for an Unlawful Purpose, Third Degree; and Aggravated Assault, Second Degree.

According to authorities, on November 14th, at approximately 4:10, p.m., members of the Paterson Police Department responded to 40 Lewis Street on a report of a stabbing.

Upon arrival officers located a 15-year- old juvenile male victim who had sustained life threatening stab wounds.

The victim was immediately transported to Saint Joseph’s Regional Medical Center in Paterson for treatment and has since been released.

Based on the investigation Estiby R. Fernandez, Robert W. Pena-Marzan, and Jimmy Polanco were identified as suspects involved.

Police arrested Fernandez on December 5th, Pena-Marzan on December 6th and Polanco turned himself into authorities on December 10th.

Estiby Fernandez appeared at Central Judicial Processing on December 6th. The State has filed a motion for pretrial detention in this matter that will be heard by a Superior Court Judge on December 15th.

Robert W. Pena-Marzan appeared at Central Judicial Processing on December 7, 2017. The State has filed a motion for pretrial detention in this matter that will be heard by a Superior Court Judge on December 15th.

Jimmy Polanco appeared at Central Judicial Processing on December 11th. The State has filed a motion for pretrial detention in this matter that will be heard by a Superior Court Judge on December 14th.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
