Man Charged in Connection with Paterson Shooting

Passaic County Prosecutor Camelia M. Valdes and Paterson Police Chief Troy Oswald announce that based upon an investigation by the Paterson Police Department, in conjunction with the Passaic County Prosecutor’s Office, Daniel A. Maldonado, 33, of Paterson, was arrested on July 16th in relation to a shooting incident that took place April 23rd in the area of Main and Weiss Street Paterson.

Officials say in addition, Maldonado was additionally charged for weapon and other offenses that took place July 16th in the area of Braun and Chadwick Street Paterson.

Authorities charged Maldonado with Attempted Murder, First Degree, Unlawful Possession of a Handgun, Second Degree; Possession of a Handgun for an Unlawful Purpose, Second Degree, and Certain Persons Not to Have Weapons, Second Degree in relation to the April 23rd incident.

Officials also charged Maldonado with Possession of CDS, Third Degree (2 counts); Possession CDS with the Intent to Distribute, Third Degree (2 counts), Possession CDS with the Intent to Distribute while within a 1000 feet of a school, Third Degree (2 counts); Unlawful Possession of a Weapon While Committing a CDS Offense, Second Degree; Unlawful Possession of a Handgun, Second Degree; Certain Persons Not to Have Weapons, Second Degree, Possession of a Weapon for an Unlawful Purpose, Second Degree; and Possession of Hollow Point Bullets, Fourth Degree in relation to an incident that occurred on July 16th.

According to authorities, on April 23rd, members of the Paterson Police Department police responded to Saint Joseph’s Regional Medical Center in Paterson, where a 22-year old male from Paterson, was seeking treatment for a non-fatal gunshot wound.

Based on the initial investigation, the victim was near the intersection of Main and Weiss Street in Paterson, when the shooting took place and Daniel A. Maldonado was identified as the shooter.

Police arrested Maldonado on July 16th in the area of Braun and Chadwick Street Paterson and additionally charged.

The sentencing exposure for Maldonado on First Degree Attempted Murder is 10-20 years New Jersey State Prison with 85% of those terms to be served before parole pursuant to the No Early Release Act and 5 years parole supervision; on Second Degree, Unlawful Possession of a Handgun is 5-10 years New Jersey State Prison with a minimum of 42 months before parole eligibility pursuant to the Graves Act; on Second Degree Possession of a Weapon for an Unlawful Purpose it is 5-10 years New Jersey State Prison with 42 months of parole ineligibility pursuant to the Graves Act; on Second Degree Certain Persons not to Possess a Firearm it is 5-10 years New Jersey State Prison with 5 years of parole ineligibility pursuant to the Graves Act; on Third Degree Possession CDS it is 3-5 years New Jersey State Prison, on Third Degree Possession CDS with the Intent to Distribute it is 3-5 years New Jersey State Prison, on Third Degree Possession CDS with the Intent to Distribute while within 1000 feet of a school it is 3-5 years New Jersey State Prison, on Second Degree Unlawful Possession of a Gun while Committing a CDS offense it is 5- 10 years New Jersey State Prison, and on Fourth Degree Hollow Point Bullets it is up to 18 months New Jersey State Prison.

Officials say Daniel A Maldonado is scheduled to appear at Central Judicial Processing on July 17th at 1:30 p.m. The State intends to file a motion for pretrial detention in this matter that will be heard by a Superior Court Judge.

A criminal complaint is merely an accusation. Despite this accusation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
