Man Arrested for Firing Gun in Passaic

Passaic County Prosecutor Camelia M. Valdes and Passaic Police Chief Luis A. Guzman announce that based upon an investigation by the Passaic Police Department, Police arrested Jose Reyes, 42, from Passaic, New Jersey, on Friday about a shooting incident that took place November 22nd in the area of 128th Passaic Street.

Police charged Mr. Reyes with Unlawful Possession of a Handgun, Second Degree; Possession of a Handgun for an Unlawful Purpose, Second Degree; Aggravated Assault, Second Degree; and Aggravated Assault, Fourth Degree.

According to authorities, on Wednesday at approximately 7:18, p.m., members of the Passaic Police Department responded to the area of 128th Passaic Street, on a report of shots fired.

Police located a vehicle that appeared to have been hit by bullets as well as shell casings in the area.

No one appeared to have suffered any injuries from the incident.

Police recovers video from surveillance cameras which led the them to identify Mr. Reyes as the shooter.

The sentencing exposure on Second Degree Unlawful Possession of a Weapon it is 5-10 years New Jersey State Prison with a minimum of 3 1⁄2 years before parole eligibility pursuant to the Graves Act; on Second Degree Possession of a Weapon for an Unlawful Purpose it is 5-10 years New Jersey State Prison with a minimum of 3 1⁄2 years before parole eligibility pursuant to the Graves; on Second Degree Aggravated Assault it is 5-10 years New Jersey State Prison with 85% of that term to be served before parole eligibility pursuant to the No Early Release Act, three years parole supervision thereafter; and on Fourth Degree Aggravated Assault it is 18 months New Jersey State Prison with 18 months to be served before parole eligibility pursuant to the Graves Act.

Authorities said Jose Reyes is scheduled to appear at Central Judicial Processing on Saturday, November 25, 2017, at 1:30, p.m.

The State intends to file a motion for pretrial detention in this matter that will be heard by a Superior Court Judge.

A criminal complaint is merely an accusation. Despite this allegation, defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt.
