A Waldwick man has been arrested and charged after authorities say he stole hundreds of thousands of dollars from a Bergen County-based company through a sophisticated financial scheme.

According to Bergen County Prosecutor Mark Musella, Jan Vincent B. Agay, 42, was taken into custody on Tuesday, January 13, and charged with second-degree theft by deception.

The arrest follows a lengthy investigation conducted by the Bergen County Prosecutor’s Office under the direction of Deputy Chief Jeff Angermeyer.

The investigation began in November 2024 after the Mahwah Police Department contacted the prosecutor’s office regarding an alleged theft of corporate funds.

Detectives from the Financial Crimes Unit determined that Agay, who previously served as the company’s information technology director, embezzled approximately $406,839 over a two-year period.

Authorities allege that Agay used company funds to purchase cryptocurrency mining hardware and virtual computing environments for his personal benefit.

Investigators determined the purchases had no legitimate business purpose and were concealed by blending them in with routine corporate expenses.

The investigation further revealed that after internal security systems flagged the unauthorized activity, Agay allegedly created security exclusions to intentionally suppress alerts related to the improper purchases, allowing the activity to continue undetected.

Agay was arrested in Waldwick and remanded to the Bergen County Jail pending his first appearance in Bergen County Superior Court in Hackensack.

The case remains under review.
