North Bergen Man Convicted of Felony Murder

Authorities in Bergen County announced the conviction of David Martinez of North Bergen for his involvement in an armed robbery that resulted in the death of David Duque Soto in Fairview on June 29, 2019.

According to officials, on March 13, following a four-week jury trial in Bergen County Superior Court, Martinez was convicted of conspiracy to commit armed robbery, armed robbery, felony murder, unlawful possession of a weapon, and possession of a firearm for an illegal purpose.

Officials say the jury acquitted Martinez of two other weapons offenses.

At trial, the State presented 16 witnesses, including three expert witnesses, and successfully argued that on the evening of June 29, 2019, Martinez was an accomplice and co-conspirator to a pre-planned armed robbery of David Duque Soto at his home in Fairview.

During this armed robbery, Duque Soto was shot and subsequently died of his injuries.
